Tunaikan janji, Pakatan Rakyat. Kami menuntut penerbitan Utusan Rakyat sign now

1.Pada 23 Februari 2008, PAS, DAP & PKR (selepas ini dirujuk sebagai Pakatan Rakyat) telah menandatangani akuan penyokongan terhadap Deklarasi Rakyat (http://harismibrahim.wordpress.com/the-peoples-voice-the-peoples-declaration ), dan dengan itu, berjanji untuk bekerja demi dan bersama rakyat dalam usaha merealisasikan aspirasi yang digariskan dalam Deklarasi Rakyat, termasuklah mengambil langkah-langkah yang sewajarnya bagi menjamin dan melindungi kebebasan media.

2.Dalam Pilihanraya Umum ke-12, lebih 4 juta penduduk Malaysia telah mengundi dan memberi mandat kepada Pakatan Rakyat untuk melaksanakan janji serta agenda politiknya yang bertujuan untuk membawa pembaharuan dan reformasi. Walaupun Barisan Nasional tetap memperoleh jumlah kerusi parlimen yang cukup bagi membentuk kerajaan persekutuan tanpa 2/3 majoriti, Pakatan Rakyat telah dipertanggungjawabkan dan telah membentuk kerajaan di negeri Kelantan, Kedah, Pulau Pinang, Perak, dan Selangor. Dalam bulan Februari 2009, kerajaan Pakatan Rakyat negeri Perak telah ditumbangkan oleh Barisan Nasional melalui beberapa percaturan politik yang tidak telus dan menimbulkan banyak syak wasangka dan menyebabkan Pakatan Rakyat kini membentuk kerajaan di empat buah negeri.

3.Media massa arus perdana, tidak kira sama ada media bercetak atau media elektronik, terus memaparkan laporan yang tidak tepat.

4.Isu campurtangan politik di NTV7 dan RTM baru-baru ini telah mengingatkan semula masyarakat bahawa selagi media dimiliki atau dikawal oleh entiti politik menerusi apa-apa cara atau kaedah, rakyat Malaysia tidak boleh secara realistik berharap untuk menerima laporan berita yang telus serta tidak berat sebelah.

5.Berkaitan hal ini, kami mengambil maklum bahawa Seksyen 25(1) Akta Mesin Cetak dan Penerbitan 1984, menyatakan bahawa Tiada apa-apa jua dalam Akta ini boleh meliputi hasil penerbitan atau membuat apa-apa dokumen atau majalah berkala oleh atau untuk Kerajaan Persekutuan atau mana-mana Kerajaan Negeri atau mana-mana badan berkanun dan kami faham bahawa menerusi seksyen tersebut, keempat-empat buah kerajaan negeri Pakatan Rakyat berhak mencetak, menerbit dan mengedar suratkhabar negeri masing-masing tanpa perlu mendapatkan permit daripada Kementerian Dalam Negeri.

6.Kami kini menuntut pimpinan Pakatan Rakyat, Menteri-Menteri Besar, Ketua Menteri dan ahli Exco keempat-empat buah kerajaan negeri Pakatan Rakyat untuk menunaikan janji mereka kepada rakyat dan mengambil setiap langkah yang sewajarnya untuk menjamin dan melindungi kebebasan media dan mengambil semua langkah yang diperlukan untuk membolehkan penerbitan, pencetakan dan pengedaran sekurang-kurangnya sebuah akhbar harian negeri, dalam Bahasa Malaysia, dalam jangka masa dua (2) bulan ini.

1.On 23rd February, 2008, PAS, DAP & PKR ( hereinafter referred to as Pakatan Rakyat ) endorsed the Peoples Declaration ( http://harismibrahim.wordpress.com/the-peoples-voice-the-peoples-declaration ), thereby pledging to work for and with the rakyat in pursuing the aspirations as therein stated, including to take the necessary measures to ensure and safeguard the freedom of the press.

2.During the 12th General Elections, more than 4 million Malaysians voted to mandate Pakatan Rakyat to carry through its declared political agenda of change and reforms. Whilst Barisan Nasional still won sufficient parliamentary seats to form the federal government, albeit with a simple majority, Pakatan Rakyat won the right to and formed the government in the states of Kelantan, Kedah, Penang, Perak and Selangor. In February, 2009, the Pakatan Rakyat state government in Perak, through a series of dubious maneuverings, was toppled by Barisan Nasional, leaving Pakatan Rakyat governing the four other states.

3.The mainstream media, both print and electronic, continues to misreport.

4.The recent incidences of political interference at NTV7 and RTM bring to the fore once again that so long as the media are in any way owned or controlled by political entities, Malaysians cannot realistically expect to receive unbiased news reporting.

5.In this regard, we note that section 25(1) of the Printing Press & Publications Act, 1984 provides that Nothing in this Act shall extend to the publication or making of any documents or periodical by or for the Federal or any State Government or any statutory body and understand this to mean that the four Pakatan Rakyat state governments are at liberty to print, publish and distribute their respective state newspapers without having to first obtain a permit from the Home Ministry to do the
same.

6.We now call on the leadership of the Pakatan Rakyat, the Mentris Besar, Chief Minister and the Exco members of the 4 Pakatan Rakyat state governments to honour their pledge to the rakyat to take the necessary measures to ensure and safeguard the freedom of the press and, to that end, take all necessary steps to facilitate the publication, printing and distribution of at least one independent state daily newspaper, in Bahasa Malaysia, within two (2) months from the date hereof.
