To Our Fellow Triple Crown Homeowners:

By now, all of you have heard about Mr. Wernick's expansion and the recommended road breakout onto Freemanville Road. Now is the time to come together as a community and do our best to prevent this from happening.

The board has spoken with our legal counsel about our available options at this time. We are also in the process of obtaining a traffic engineering study to have expert proof of the detrimental effect this plan will have on our neighborhood. Although some people may not view a second entrance as a problem, there are many reasons why we need to stop this.

First, as many have noted, we have many children in this neighborhood. We have an average of three children per house, and over 100 children on school buses. To have cut-through traffic driving past over 60\% of the houses in this neighborhood is a safety risk to all. Further, Triple Crown Drive would become the "main street," bringing all traffic past our playground, amenities area and park. This is not what any of us expected when we moved to this neighborhood.

Second, there are over 50,000 proposed homes in Cherokee County further up Birmingham Highway, not to mention Mr. Wernick's own project at Birmingham Crossroads. Even if you believe that the cross traffic will not be a problem now, fast forward even a year and envision what type of traffic will be coming down Birmingham Highway. People will want to keep moving and not get stuck in traffic, leading them to cut through our neighborhood. We have spoken with people from other communities who have a similar cut through. One community noted that although their cut through is complicated with lots of turns, they still have in excess of 100 cars per day traveling at 50 mph coming through the neighborhood.

Third, such a cut through will directly affect everyone's property values. Once one house is sold for less than market value due to traffic, everyone will be affected.

Although it is true that the county likes to have a separate entrance when there are more than 80 homes, this is certainly not legally required. We all know communities that have more than 80 homes with only one entrance/exit. The traffic study will help us show the county why we should not have the separate entrance.

Finally, there has been some talk about gating the community. Although this could be an option at a later date, it is not something that can be done in a matter of weeks, if at all. First, the streets have already been dedicated to Fulton County, so the HOA must request to have the streets back. Fulton County is under no obligation to agree, and it can be a lengthy and expensive process. Second, there is the cost of the gates and maintenance of the gates. Third, when the community is gated, the HOA is responsible for maintaining the streets; i.e., they are no longer public. Rough estimates on street maintenance for a community of our size is $10,000-$20,000 per year for upkeep and another $30,000-$40,000 in reserves. Accordingly, this idea must move to the back burner and the priority must be to prevent the breakthrough to Freemanville.

Also, we are asking that each household try to send someone to the Fulton County Commissioners Meeting on Wednesday November 1, 2006 at 10:00 AM. The address is 141 Pryor Street, SW, Atlanta, GA. Our attorney has advised us that if we do not have a good showing at the meeting, it is unlikely that we will be successful. We know how busy everyone is, but please make this a priority for the benefit of your community. It will be much easier and cost-effective to prevent this from happening, rather than to try to remedy the problem after the fact.
