SANO EI SEKSIN OSTON KRIMINALISOINNILLE

Me allekirjoittaneet haluamme ilmoittaa, ettд vastustamme Suomen Hallituksen lakiesityksen HE 221/2005 seksin oston kriminalisointia koskevaa osuutta.

Huomautamme, ettд emme vastusta muita lakiesityksen kohtia.

Mielipiteemme perustelut ovat seuraavat:

1. Lain perusteluissa vдitetддn pyrittдvдn suojelemaan prostituoituja, parantamaan heidдn sosiaalista asemaansa ja tasa-arvoaan sekд ihmisarvoaan.

Prostituoidut ovat sekд jдrjestцnsд (SALLI) kautta, ettд yksityisissд mielipiteissддn ilmoittaneet jyrkдsti vastustavansa seksin oston kriminalisointia, koska se tosiasiassa ja tutkitusti johtaa juuri pдinvastaisiin vaikutuksiin, kuin perusteluissa sanotaan. Tutkimukset Ruotsin tilanteesta kertovat, ettд tдmд nдkemys on oikeutettu. Seksin oston kriminalisointi itse asiassa vaikuttaisi erittдin negatiivisesti juuri prostituoitujen elдmддn. Laki mm. altistaisi prostituoidut vдkivallalle ja lisдisi rikollisten vaikutusta prostituution yhteydessд huomattavasti.

Vдite, ettд suomalaiset prostituoidut eivдt toimisi aidon vapaaehtoisesti on mielestдmme sekд prostituoituja loukkaava, ettд perusteeton. Tutkimusten mukaan prostituoidut Suomessa ovat tehneet pддtцksensд prostituoidun tyцhцn ryhtymisestд tдysin itsenдisesti ja vapaaehtoisesti. On myцs huomattava, ettд Eurooppalaisessa lainsддdдnnцssд ja useissa sopimuksissa on selvдsti mддritelty vapaaehtoisen prostituution olemassaolo.

Niihin sosiaalisiin ongelmiin, joita prostituution yhteydessд joskus ilmenee, pitдisi vastata sosiaalipoliittisin keinoin, ei kriminalisoimalla.

2. Lakiesityksen perusteluissa vдitetддn lailla kavennettavan mm. paritusrikollisuuden mahdollisuuksia. Lailla vдitetддn myцs olevan ihmiskauppaa ehkдisevд vaikutus.

Suomalaisessa prostituutiossa ei tutkitusti ole juurikaan kytkentдд rikollisuuteen. Kaikki suomalaiset prostituoidut tyцskentelevдt itsenдisesti. Kokonaisuutena vain noin 20-30\% kaikista prostituoiduista Suomessa, siis ulkomaalaiset mukaan lukien, tyцskentelee parittajaksi katsottavan henkilцn kanssa yhteistyцssд. Tutkimukset Ruotsissa osoittavat, ettд laki pдinvastoin lisдд rikollisten, varsinkin parittajien toiminnan edellytyksiд, ei kavenna niitд.

Ihmiskauppaan liittyviд tapauksia ei Suomessa ole viety oikeuteen yhtддn kappaletta. Ne yksittдiset tapaukset, joissa tдllaista toimintaa epдillддn, on tuotu viranomaisten tietoon pддosin asiakkaiden toimesta. On selvдд, ettд seksin osto kriminalisoimalla vain vaikeutetaan oikean ihmiskaupan ja muiden rikosten tutkintaa ja tuhlataan poliisin resursseja epдolennaiseen.

3. Lakiesityksen perusteluissa lailla vдitetддn parannettavan tasa-arvoa yhteiskunnassa ja vaikutettavan seksin ostoon vдhentдvдsti. Lailla halutaan perustelujen mukaan viestittдд seksin ostamisen olevan moraalisesti vддrin.

Mielestдmme yhteiskunnan tasa-arvolla ei ole mitддn tekemistд seksin oston ja myynnin kanssa. Seksiд ostavat ja myyvдt sekд miehet, ettд naiset.

On myцs outoa vedota moraaliin, kun koko muu Eurooppa (paitsi Ruotsi) on tдssд asiassa aivan eri linjoilla kuin tдmд lakiesitys. Jos kerran lainsддdдntццn moraalia ja yhteistд arvopohjaa tarvitaan, niin suosittelemme etsimддn sitд Euroopan Unionin maiden lainsддdдnnцstд.

Lakiesityksen perustelujen tavoite, ettд seksin osto vдhenisi lain seurauksena, ei varmasti tulisi toteutumaan. Seksin ostajille suunnatuissa useissa kyselyissд on saatu tulokseksi, ettд ehkд noin 15 \% ostajista lopettaisi lain vuoksi seksin oston Suomessa, mutta hekin suuntaisivat sen jдlkeen ostot Suomen rajojen ulkopuolelle.
Ruotsissa ei seksin ostaminen ole ulkopuolisten tutkijoiden arvioiden mukaan vдhentynyt kokonaisuudessaan juuri lainkaan. Ruotsista ulkomaille suuntautuva seksiturismi on kyllд lisддntynyt selvдsti.

Mielestдmme on erittдin kyseenalaista tehdд ainakin 300 000 Suomen kansalaista rikollisiksi asiassa, joka ei missддn muualla Euroopassa (paitsi Ruotsissa) ole rikollista. On selvдд, ettд nдin ristiriitainen ja Eurooppalaisesta nдkemyksestд suuresti poikkeava vain pienen vдhemmistцn moraaliin perustuva laki aiheuttaisi vakavaa lain kunnioituksen ja arvostuksen vдhenemistд Suomessa.

4. Lakiesityksessд annetaan ymmдrtдд, ettд sддtдmдllд seksin oston kriminalisoiva laki linjattaisiin Suomen lainsддdдntцд jotenkin yhtenдiseksi EU:n lainsддdдnnцn ja Suomea sitovien kansainvдlisten sopimusten kanssa. Lakiesityksen ei myцskддn katsota olevan ristiriidassa Suomen lainsддdдnnцn tai EU:n lainsддdдnnцn kanssa.

Allekirjoittajien mielestд laki loukkaisi ainakin Suomen perustuslain seuraavia pykдliд: 6, 7, 10, 18, 22 ja 118. Laki loukkaisi selvдsti myцs EN:n ihmisoikeussopimusta puuttumalla perusteettomasti kansalaisten yksityisyyteen. Lisдksi laki loukkaisi EU:n perustamissopimuksen mukaista vapaata elinkeinon harjoittamista.

Ja kun kerran kansainvдlisestд lainsддdдnnцstд puhutaan, haluamme vielд kerran huomauttaa, ettд Ruotsi on ainoa maa maailmassa, joka on kriminalisoinut seksin oston (eikд myyntiд). Euroopassa ei yhdessдkддn muussa valtiossa ole kriminalisoitu seksin ostoa. Pдinvastoin, useimmissa Euroopan maissa on tunnustettu virallisesti vapaaehtoisuuteen perustuva prostituutio ja laillistettu seksiyrittдminen.

Kansainvдlisten sopimusten osalta haluamme muistuttaa, ettд missддn Suomea sitovassa kansainvдlisessд sopimuksessa ei ole vaatimusta seksin oston kriminalisoimiseksi.

Ehdotamme, ettд lainsддdдnnцssд tдssдkin tapauksessa pyritддn yhtenдisyyteen eikд ristiriitaan EU:n muiden jдsenvaltioiden lainsддdдnnцn ja kansainvдlisten sopimusten kanssa.

Lakiesitysten pitдisi olla sisдllцltддn kansalaisten ja hallinnon selkeдsti hyvдksymiд. Ihmettelemme miksei enдд tдmдn lain esittelyvaiheessa ole tuotu esille sitд, ettд kaikissa mielipidekyselyissд selvд enemmistц vastaajista on vastustanut tдllaista lakia.
Lakiesityksen lausuntokierroksella alkuperдistд lakiesitystд vuonna 2003 kannatti 18 ja vastusti 21 lausunnonantajaa. Tдmд kertoo siitд, ettд lain sisдltцд ei ole hyvдksytty yleisesti. Myцs lain valmistellut tyцryhmд jakaantui; Seitsemдstд jдsenestд kolme, mukaan lukien tyцryhmдn johtaja, vastusti seksin oston yksiselitteistд kriminalisointia.

Ehdotamme, ettд Suomessakin hylдtддn tдmд lakiesitys, jossa ei luvalla sanoen tunnu olevan mitддn jдrkeд.

SAY NO TO CRIMINALIZING THE PURCHASING OF THE SEX IN FINLAND

The signatorys like to announce that we oppose the legislative proposal HE 221/2005 given by Finnish Government. We would like to emphasize that we oppose only the part of the proposal which handles the purchasing of the sex.

The arguments for our statement are as follows:

1.In the basic argumentation of the proposal it is said that the law would protect the prostitutes, improve their social status and equality and support their human dignity.

Finnish prostitutes themselves have announced in their private statements and also through their trade union SALLI that they strongly oppose the criminalizing of the purchasing of sex. Thats because the law will actually lead into completely opposite effects than objectives mentioned in the proposal. This fact is also shown in many studies. This kind of law would effect extremely negatively into the lives of the prostitutes. It would, for example, increase the risk of the violence in their work and give much better opportunities to the criminals to operate in the prostitution.

According to the proposal, the Finnish prostitutes do not work truly voluntarily. This statement is not only insulting the prostitutes but its also without justification. According to many studies the Finnish prostitutes have without exception decided independently of their profession. Its also important to remember, that many European laws and agreements have defined the prostitution, which is based on the free will and independent decision.

The social problems, connected sometimes to prostitution, should be taken care by the social services, not by criminalizing.

2. In the basic argumentation of the proposal it is said that the law is supposed to effect to the criminal organizations and decrease procurers opportunities. The proposal also says that law would prevent the human trafficking.

According to the studies there is no criminal connection in the Finnish prostitution. All Finnish prostitutes are working independently. On daily basis approximately 20 30\% of all prostitutes in Finland, including the foreigners, are working in co-operation with a procurer. Studies in Sweden show clearly that this kind of law do not narrow the possibilities of the criminals, on the contrary, it improves the opportunities of the criminal organizations.

In Finland there hasnt been any human trafficking cases in the court. Those few cases, in which trafficking has been suspected, have been brought up mainly by customers. It is obvious that by criminalizing the purchasing of the sex, the investigation of the real trafficking only comes more difficult. This would also waste the limited resources of the police to immaterial and very arguable purposes.

3. In the basic argumentation of the proposal it is said that the law would improve the equality in the society. It is also said that the law would decrease the purchase of the sex and send a message that purchasing the sex is morally wrong.

According to our point of view, the equality in the society has nothing to do with the prostitution. Actually the sex is purchased and offered by both men and women.

We think that it is quite strange to appeal to moral issues in the first place, and we would like to remind, that all other European countries (except Sweden) have completely different point of view in this matter.

If there is a reason to look to Finnish legislation from the moral point of view, we suggest, that Finland starts looking to legislation in European Union Countries.

It is said in the proposal, that the decreasing of the purchase of the sex is one of the purposes of the law. For sure, that would not happen. The results of many studies among the customers had given the result that approximately 15 \% of the customers would stop their activities in Finland, if the law would come. Only they would just continue purchasing sex abroad.
According the studies, and many independent observers, the purchasing of sex hasnt decreases in Sweden since the law came active 1999. Instead, the sex tourism abroad has clearly increased.

We think that it is very questionable to make at least 300 000 Finnish citizen criminals in a matter which is not criminalized anywhere else in Europe (except in Sweden). We are seriously afraid, that this would also create an essential decrease in the respect of the law.

4. In the basic argumentation of the proposal it is said that with this law Finland would also standardize its legislation with European Union legislation and some international agreements. It is also said, that this proposed legislation is not conflicting with the Finnish present legislation and constitution.

We, the undersigned, suspect that this proposal is conflicting Finnish constitution at least in the paragraphs 6, 7, 10, 18, 22 and 118. We also suspect that the law would conflict the European Human Rights agreement. Law could also be against the right to conduct business in Europe.

We would also remind, one more time, that Sweden is the only country in the world, where the purchasing of the sex is illegal (and not selling the sex). No other country in Europe has criminalized the purchase of the sex. On the contrary; In most of the European countries the prostitution is legalized and is under the control of the state.

We would also like to remind that there are no international agreements which would demand or expect the criminalizing of the purchase of the sex.
We suggest that Finland follows the basic rule of standardize the legislation with EU.

The law proposals should be generally accepted by the citizens and by the administration. All previous polls have shown that the clear majority of Finnish people oppose this kind of law. When the law proposal was circulating among different public and private organizations and officials the result was that 18 respondents supported and 21 respondents opposed the proposal. 6 respondents required more information. Even the working group itself was contradictory; Three out of seven members of the group were opposing the criminalizing of the purchasing of the sex. One of opposes was the leader of the working group.

We suggest that this irrational law proposal should be rejected in the Parliament of Finland.
