Declaro minha adesгo а seguinte Petiзгo, protocolada por uma comitiva de representantes indнgenas na Comissгo de Direitos Humanos da Cвmara dos Deputados do Congresso Brasileiro:

PETIЗГO

Ao Exmo. Sr Deputado Luiz Couto, Presidente da Comissгo de Direitos Humanos da Cвmara dos Deputados,
а Exma. Deputada Janete Rocha Pietб, Relatora do Projeto de Lei 1057/2007 e
aos demais membros da Comissгo.

Nуs, os нndios da aldeia Yawalapiti, localizada na regiгo conhecida por Alto Xingu, no Parque Indнgena do Xingu, estado do Mato Grosso, e as lideranзas indнgenas Mebengokrй da Terra Indнgena Kayapу, localizada no estado do Parб, surpresos com a notнcia que recebemos, na mesma semana em que se comemora o Dia do Нndio, data especial em que diversas lideranзas indнgenas do Brasil se deslocam a Brasнlia para participar das comemoraзхes festivas e manifestaзхes polнticas em prol da defesa de seus direitos, sobre a iminente votaзгo do projeto de Lei 1057/2007, viemos a manifestar que:

1. entendemos que esse Projeto de Lei visa a indevida intrusгo e supervisгo da vida cotidiana em nossas aldeias com o suposto de que nela se perpetram freqьentemente crimes contras as crianзas; e
2. que o mencionado PL й inconstitucional, e fere os Convкnios 169 e o espнrito da Declaraзгo dos Direitos dos Povos indнgenas da ONU.

O espanto se deve tambйm a que, como parte interessada, os povos indнgenas nгo foram consultados, ouvidos ou convidados a participarem das discussхes acerca do assunto, mesmo sendo os protagonistas deste cenбrio. Nгo se pode negar aos povos indнgenas o direito de participar deste processo e de serem ouvidos. Mais uma vez, os povos indнgenas sгo alvo de criticas e visхes distorcidas sobre suas tradiзхes culturais, as quais sгo quase sempre julgadas sumariamente por aqueles que nгo compreendem a complexidade da diversidade brasileira. O imaginбrio das lendas e estуrias do passado povoa a mente daqueles que sugerem a aprovaзгo desta Lei. O Estado й laico, aos нndios a constituiзгo federal lhes garante seus usos, costumes e tradiзхes, a OIT prevк a participaзгo indнgena nos processos de seu interesse e, no entanto, os indнgenas continuam а margem das discussхes polнticas do paнs e dos temas que afetam sua vida diretamente.

Alйm dos motivos elencados acima, este projeto de Lei se coloca na contramгo da histуria, considerando que o STF acaba de ter um grande avanзo em defesa dos direitos indнgenas com o caso de Raposa Serra do Sol em Roraima. Nгo й possнvel que o Congresso Nacional desconsidere esta tendкncia no destino da naзгo brasileira.

Pedimos, portanto:
1. que a "lei de criminalizaзгo do infanticнdio" nгo seja votada sem consulta ampla aos povos indнgenas
2. que a organizaзгo evangйlica internacional ATTINI/JOCUM se abstenha de continuar retirando crianзas do convнvio com seus familiares indнgenas como vem fazendo em diversas regiхes do paнs;
3. que a organizaзгo evangйlica internacional ATTINI/JOCUM se abstenha de continuar difamando os нndios do Brasil e seu modo de vida como vem fazendo no site YouTube, pela internet e nos meios de comunicaзгo massiva assim como neste mesmo Congresso Nacional; e
4. que finalmente compreendam que os povos indнgenas, como todos os outros povos do mundo, mudam suas prбticas mediante um processo dinвmico de deliberaзгo interna ao longo da sua histуria.

I adhere to the following Petition, presented by a group of Indian delegates to the Human Rights Commission of the House of Representatives of the Brazilian Congress:

PETITION

To the Honorable Representative Luiz Couto, President of the Human Rights Commission of the House of Representatives,
to the Honorable Representative Janete Rocha Pietб, rapporteur for the Draft Law 1057/2007 and
to all members of the Commission.

We, Indians of the Yawalapнti village, located in the region known as Alto Xingu, at the Indigenous Park of Xingu, Mato Grosso State, and indigenous leaders Mebengokrй from the Kayapу territory of Parб State, surprised with the news received this very week, when Brazil commemorates the Day of Indians, special date in which indigenous leaders come to Brasilia to participate in the celebrations and political manifestations to defend their rights, about the imminent vote of the Law Project 1057/2007, we are here to say that:

1. We understand that such Draft Law aims at an undue intrusion and surveillance of our villages daily life alleging that there we perpetrate frequent crimes against our children; and
2. That the mentioned Draft Law is unconstitutional and hurts the ILO Convention 169 and the spirit of UNs Declaration on the Rights of Indigenous People.

Our astonishment arises also from the fact that, as an interested part, the indigenous peoples were neither consulted, nor heard, nor invited to participate in the debate on the matter, even when they are the main actors in this scenario. It is not longer possible to deny to Indian peoples the right to participate in this process and to be heard. Once again, indigenous peoples are the victims of criticisms and distorted views of their cultural traditions, often judged summarily by those who are not capable of understanding the complexities of Brazilian diversity. The imaginary of legends and stories of the past haunt the minds of those that suggest the approval of this law. The State is secular, the Federal Constitution grants Indians their uses, customs and traditions, the 169 ILO Convention obliges their participation in the processes of interest to them, and, even so, Indians continue to be excluded from the political discussions of their country and from the matters that directly affect their lives.

Besides the reasons listed, this Draft Law is against the trend of history, considering that the Supreme Federal Court has just taken a great step forward in the defense of indigenous rights sanctioning the land Raposa Serra do Sol as a continuous territory in Roraima. It is not possible for the National Congress to ignore that direction in the destiny of the Brazilian nation.

We therefore request:
1. That the law criminalizing the supposed practice of infanticide must not be voted without wide consultation to indigenous peoples;
2. that the international evangelical organization ATTINI/JOCUM must abstain from continuing the withdrawal of indigenous children from their homes and lives amidst their relatives as it has being doing in different regions of the country.
3. that the international evangelical organization ATTINI/JOCUM must abstain from continuing libeling Brazilian Indians and their way of life as it has being doing in the site YouTube, through internet and through the media, as well as in this very National Congress; and
4. that they finally come to understand that indigenous peoples, as much as all the other peoples of the world, change their practices through a dynamic process of internal deliberation along their history.
