Subject: Open Letter to Myanmar Government Requesting Clarification about the Double Taxation


Dear Sir,

I am a Myanmar National holding Singapore Permanent Resident status and currently working/residing in Singapore. Right now, I am paying income taxes to Both Singapore Government and Myanmar Embassy. I think this matter is always a big issue for all Myanmar people working in foreign countries. Now I am writing this petition letter on behalves of all Myanmar Nationals paying income taxes to both Myanmar and Singapore Government.

I feel it is very unfair to be double-taxed. So I had written an email to Singapore IRAS to clarify me on this matter and an assistant manager of Taxpayer Services Division replied me an email as follow:

"If you are exercising your employment in Singapore, your income will be taxed in Singapore. You may want to contact your country's tax authority if any tax credit on the tax paid in Singapore."
(Please let me know if you need an original email for proven purpose.)

And I also found out that there is an Agreement between Singapore and Myanmar governments for the Avoidance of Double Taxation and the Prevention of Fiscal Evasion with Respect to Taxes on Income signed by Lim Hng Kiang (for Government of Singapore) and Khin Maung Thein (for Government of Myanmar) on 23 February 1999. The Agreement was effective on 1 January 2001 (Singapore) and 1 April 2001 (Myanmar) and the year of assessment was on and after 1 January 2002 (Singapore) and 1 April 2002 (Myanmar). I am indeed surprised to find out that Myanmar Nationals working and residing in Singapore (or any other countries) are released from Paying Income Tax to Myanmar Government which refer to the paragraph 1, article 15 of the mentioned Agreement as follow:

Subject to the provisions of Articles 16, 18 and 19, salaries, wages and other similar remuneration derived by a resident of a Contracting State in respect of an employment shall be taxable only in that State unless the employment is exercised in the other Contracting State.

I would like to seek your kind explanation on followings as soon as possible:

1. Whether any tax has been credited to Myanmar government on the tax paid in Singapore (or other countries) and vice versa. (See paragraph 2, article 24 of the mentioned Agreement.)

2. Please direct us if there any official references or rules or any section from the Myanmar Taxation Law mentioning as follow or other relevant/similar meanings as follow:
An individual requires to pay an income tax of 10\% of his/her monthly salaries, wages and other similar remuneration derived from his residing country in respect of an employment to Myanmar Government despite his/her legal residential and employment status in another country outside of Union of Myanmar.

(See articles 14 and 15 of the mentioned Agreement.)

3. If there is any law or official references restricting Myanmar National from paying income tax for working and residing outside of Myanmar, please kindly make an official announcement to public and media by stating clearly that All Myanmar Nationals working and residing outside of Myanmar are Released from Double Taxation and not Necessary to pay Income Tax to Myanmar Government. And return the exact amount of income tax if any Myanmar Nationals had paid after 1 January 2002 (Singapore) and 1 April 2002 (Myanmar).
