RE: Fence Height Regulation

The purpose of this petition is to amend the fencing regulations set by the Condo Committee no. 699 on Wednesday, June 15th, 2005.

Background Information:

(1) The current condo regulation for fence height is a maximum of 5 feet. The city of Ottawa by-law states, that the maximum height for a fence in a residential area is 7 feet in height. A 5 foot privacy fence does not provide adequate privacy for the homeowner(s). If you have any open water, such as a pool or hot tub, 5 feet is the minimum requirement by the City of Ottawa fencing by-law. The current regulation was made to conform to the existing privacy fence.

(2) The current regulation was passed when less than 50\% of the home owners occupied homes in the New Emerald Meadows. The condominium Act states that any regulations made can only apply to the owners that occupied units at the time when the regulation was passed. However, owners occupying homes after the regulation was passed are being forced to comply with the current regulations.

(3) The Condominium Act states that the owners can amend any regulation within 2 years of the original ruling. A regulation will remain until there is a majority vote.

Proposal:

We, the undersigned residents of New Emerald Meadows call upon the Ottawa Carleton Standard Condominium Corporation No. 699 to amend the maximum fence height regulation to 7 feet to provide more adequate privacy.

We, the undersigned residents of New Emerald Meadows call upon the Ottawa Carleton Standard Condominium Corporation No. 699 to allow the removal of the existing privacy fence, in replacement of a 7 foot privacy fence.
