A large Akita dog, roaming the neighborhood unaccompanied by its owner or any other person and without a leash or collar with rabies tags, attacked and seriously injured my dog Finbar, a 13 pound Bichon, on December 20, 2004 at my apartment complex at 203 rd Street, Bayside, NY.

Finbar who was on his own property and on a leash on route to see his eye doctor for cataracts sustained serious injuries to one of his hind legs, has undergone surgery and as of this writing, remains in intensive care.

The owner of the dog that attacked Finbar resides 40-22 204th Street Bayside, NY. This dog has been spotted roaming the neighborhood without a leash on several occasions by several neighbors.

The New York City Health Code, Section 161.05, also known as the:
Leash Law, requires that a person who owns, possesses or controls a dogs shall not permit the dog to be in any public places unless the dog is effectively restrained by a leash or chain not more than six feet long.


The purpose of this petition is to appeal to our local police precinct to enforce Section 161.05 of the New York City Health Code in our neighborhood and to ensure that the owner of this attack dog abides by the law. Specifically this petition appeals to the local police precinct the following restrictions be placed on the dog that attacked Finbar:

1. The dog shall not be permitted in any public place unless the dog is restrained by a leash or chain not more than six feet long.

2. The dog must have & wear up-to-date identification tags and rabies tags
at all times.

o When owners were asked for rabies vaccine information owners refused to release information to Finbars veterinarian or owner.

3. The dog must be muzzled at all times when it is brought outside of the
owners house, including at any time the dog is in the yard.

This petition will be presented to the owners of the dog, our local police precinct and our community board.
