Dear Congressman Darrell Issa and US Congress,

I am writing to request information and permission, to obtain the deed for ownership of a placer mining claim of 20 acres in Riverside County I recently acquired through the Bureau of Land Management (http://www.blm.gov/ca/st/en.html). My main interest in obtaining the deed to my 20 acre placer mining claim in Riverside County is to realize a life time dream of having a vineyard to produce wine. I currently have six grapevines, one of each as follows: Chardonnay, Zinfandel, Merlot, Pinot Noir, Cabernet Sauvignon, and Sangiovese. Temecula is a few miles away which produce grape wine commercially. I believe the temperature in this area will be good for the production of these wines.

Purchasing California land has become extremely expensive. I would rather spend thousands on preparing the land to make a vineyard than spending millions just to buy a piece of land in California. The placer mining claim I am inquiring about is located between Perris and Lake Elsinore, on the north side of Canyon Lake where the lake begins to form meeting the San Jacinto River. In the Riverside County Clerk & Recorders Office my placer mining claim can be found under: DOC#2007-0266828.

In the Bureau of Land Management Office my placer mining claim can be found under: CAMC0287934. The legal subdivision for my placer mining claim is Aliquot Part: E , SE , SE . Section: 14, Township: 5S, Range: 4W, Meridian: SBM.

The Mineral Patent Moratorium: Effective October 1, 1994, Congress imposed a moratorium on spending appropriated funds for the acceptance or processing of mineral patent applications that had not yet received First Half Final Certificate (FHFC) or were not in Washington, D. C. for Secretarial review of FHFC on or before September 30, 1994. Until the moratorium is lifted, the BLM will not accept any new applications.

A patented mining claim is one for which the Federal Government has passed its title to the claimant, making it private land. A person may mine and remove minerals from a mining claim without a mineral patent. However, a mineral patent gives the owner exclusive title to the locatable minerals. In most cases, it also gives the owner title to the surface and other resources. Requirements for filing mineral patent applications may be found at 43 CFR 3860 (www.blm.gov/ca/st/en/prog/minerals/patents.html).

A document revised by the Bureau of Land Management on October 1, 2004, states the price to purchase placer claims are fixed at $2.50 per acre (www.blm.gov/nhp/news/regulatory/3100f_cost-recovery/3863.1.html).

I understand the purpose behind the Mineral Patent Moratorium is to regulate mining companies from obtaining federal land for mining purposes and then abandoning them without reclamation of the land. I am not interested in mining so much as owning the 20 acres to begin the vineyard. I believe this vineyard will raise the value of near by properties. A mining claim will mostly benefit the claimant and will take years for the land to be restored to its scenic environment. I am writing to see if there is something that can be done for me to obtain the deed for these 20 acres specifically for the purpose of owning a vineyard that produces wine and not for mining. Congress has allowed a bill to pass for the Pechanga Tribe to obtain over a 1000 acres from the BLM public land where they will most likely expand their casino and all I am asking for is 20 acres to make a vineyard. Thank you for your time. Your signatures will be appreciated.
